出生公证 Birth notarization in China

公证目的：通过证明无争议的法律行为，有法律意义的时间和文书的真实性，合法性的非诉讼活动，确认当事人的权利义务关系，以消除各种纠纷隐患，平衡当事人之间利害冲突，防患于未然。

Purpose of notarization: By proving undisputed legal actions, the authenticity of time and documents with legal significance, and legal non-lawsuit activities, confirm the relationship of rights and interests of the parties concerned, thereby eliminating various potential disputes, balancing the conflict of interest among parties concerned and nipping the conflict in the bud.

1、办理出生公证需要提交的材料

办理出生公证一般需要提交的材料：

Materials to be submitted for proceeding with birth notarization generally include:

1、申请人的有效身份证件。

1. A valid ID card of the applicant.

2、申请人的《居民户口簿》，集体户籍的申请人提供《常住人口登记卡》本人页原件及经过户籍所在单位盖章的首页复印件。

2. The household register of the applicant, and in the case of an institutional household, the applicant shall provide an original copy of his/her page of Register Card for Permanent Resident and a photocopy of the first page of the institutional register attached with a seal.

3、如需委托他人代办，提供受托人的身份证件，手写委托书（写明因何原因委托谁办理何种公证，本人签名，原件或传真件均可）。

3. If the applicant needs to entrust someone to proceed with the notarization for him/her, the applicant shall provide the ID card of the entrustee, a hand-written power of attorney (indicating for what reason, who is entrusted to proceed with what kind of notarization, signed by the applicant, an original copy or a fax can be accepted).

4、出生证明可以根据自身情况，从以下三种证明材料中任选其一：①由户籍地派出所或人事档案存放单位出具的出生证明信；②如果您以前办理过出生公证，可以提供原出生公证书；③《出生医学证明》（如果《出生医学证明》内容缺项、涂改、填写字迹不一致，《出生医学证明》不能作为唯一证据使用，还需提供其他证明材料中的任意一项）。如果上述证明中不能体现父母公民身份号码时，还需提供申请人父母身份证件或户口簿复印件，无法提供的出生公证书中将无父母的公民身份号码。

4. You can select any one from the following three kinds of certificates as your birth certificate based on your situation: ①The birth certificate letter issued by the police station of your registered residence or the unit where your personnel archives are stored; ②If you ever proceeded with a birth notarization, you can provide your original birth notarization; ③Medical certificate of birth (If your Medical certificate of birth has missed some item, been obliterated or is inconsistent in handwriting, it cannot be used as the only evidence, but shall be used along with any of other evidentiary materials). If the above evidences cannot reflect the citizen's ID card numbers of your parents, the applicant shall also provide a photocopy of the ID card or household register of his/her parents; otherwise, the birth notarization will not include the citizen's ID card numbers of parents.

5、使用地为美国、法国、泰国、意大利、新加坡、哥伦比亚的出生公证书，需要提供申请人近期二寸彩色证件照（背景不限）n+1张（n代表您所需的公证书份数）。

5. For a birth notarization which will be used in the US, France, Thailand, Italy, Singapore and Columbia, n+1 recent 2-inch colored identification photos (background unlimited) of the applicant (n represents the number of copies of notarization you need).

6、如果您所提供的证据材料不严谨、不完整，不能准确证明所办公证事项时，请根据公证员要求补充证明材料。

6. If the evidentiary materials you provide are not rigorous and complete, and cannot correctly prove the notarized issues, please supplement the evidentiary materials based on the requirements of the notary staff.

注：非京籍的申请人需提供在北京一年以上且在有效期内的暂住证或北京市工作居住证，未成年非京籍申请人提供《北京市中小学学生卡》。

Note: An applicant not registered as a permanent resident of Beijing needs to provide a valid temporary residence permit proving residence in Beijing for over a year or a work residence permit of Beijing, while a minor applicant not registered as a permanent resident of Beijing needs to provide Student Card of Primary or Secondary Schools of Beijing.

公证书用于美国、韩国、奥地利、俄罗斯、哈萨克斯坦等国，需要加做译文相符公证。

If the notarization is to be used in countries such as the US, Korea, Austria, Russia and Kazakhstan, it shall be attached with a notarization on consistency of its translation version.

特别提示：

Special reminders:

1、凡在域外出生的事实，一般不予公证。

1. Any fact of birth beyond the borders of China generally won't be notarized.

2、出生证明信中应写明生父母的姓名，生父母已死亡的，要在他们姓名后面加括号注明并提供相应的死亡证明。

2. The evidentiary letter of birth should indicate the names of biological parents. If the biological parents have passed away, a bracket shall be put behind their names to indicate their death and corresponding death certificates shall be provided.

3、出生证明信中的出生地点应具体、明确，精确到县、市一级，地名应写全称。

3. The birth place in the evidentiary letter of birth should be specific and concrete to the level of county and city, and the name of place should be in full form.

4、出生证明信中的出生日期应写明年、月、日，采用公历。

4. The birth date in an evidentiary letter of birth should indicate MM/DD/YY in Gregorian calendar.

5、根据当事人的申请，也可以为其办理《出生医学证明》影印本与原本内容相符公证，提供材料与出生公证相同。

5. Based on the application of the party concerned, we can also proceed with a notarization on conformity between his/her photocopy of Medical Certificate of Birth and its original copy, for which same materials shall be provided as the case of birth notarization.
